PURCHASING YOUR NEW PROPERTY
When the property "of your dreams" has been found, and the price has been negotiated, the following will normally takes place.
A contract known as a "compromis de vente" is required to be signed and a deposit (normally 10% of the purchase price) be forwarded to the Notaire. This is a legally binding contract, and unless a clause is detailed within the contract ("clause suspensive") ie. Subject to satisfactory Structural Building Survey, it is totally enforceable. You do however have a 7 day grace period, which enables you to terminate the transaction after signing and deposit returned.
An increasing number of UK buyers are now including these clauses to the "compromis de vente" to allow adequate time to employ us at France Surveyors to complete a Structural Building Survey, to protect you and your investment.
Please be aware the vendor and immobiler (estate agent) will normally be opposed to such a clause being included, as the property sale could be compromised due to its inclusion.
Structural Building Surveys can normally be carried out at short notice, but not always within the 7 day period after signing. If you wish to complete the contract without the clauses included, please contact us promptly to enable us to fulfil your requirements.
